Know The FMCSA Clearinghouse Facts
On October 1, 2019 the Department of Transportation’s Federal Motor Carrier Safety Administration, (FMCSA) opened registration for Employers, Medical Review Officers (MRO), Consortia / Third Party Administrators (C/TPA) and Substance Abuse Professionals (SAP) in the FMCSA “Clearinghouse”. This Clearinghouse will be used to as an electronic database to store driver information and FMCSA drug and/or alcohol violations.
Beginning January 6, 2020 Employers, MRO’s, SAPs and your C/TPA (if you authorize us to perform for you) will be required to enter information with regards to current and prospective employee violations, treatment programs, return to duty testing etc., into the Clearinghouse database as detailed in the attached documents.
Employers and/or their authorized users must begin on January 6, 2020, to conduct full queries of all prospective/CDL holders that will operate a commercial motor vehicle for your company before they perform safety sensitive duties. The prospective employee must register in the Clearinghouse and give electronic consent to the employer to conduct a full Clearinghouse query. You must also continue to submit the written “3 year previous employer request”, for employee information as well as conduct the query in the Clearinghouse until January 6, 2023. The employer is required to maintain all records of queries and previous employer requests in the employee’s confidential, Drug and Alcohol Testing file.
Employers or their authorized users must report pre-employment driver violations in the clearinghouse within 3 business days of being notified of the violation.
Annual limited queries must be conducted on current employees. The employee must also give consent for a limited query; this will be a written consent. The employee will be required to provide an electronic consent in the Clearinghouse database for the full consent.
- MRO verified positive result, adulterated or substituted drug test result
- An alcohol confirmation test of 0.04 or higher
- Refusal to submit to a drug or alcohol test
- An employer’s report of actual knowledge, as defined in 49 CFR §382.107
- On duty alcohol use pursuant to 49 CFR §382.205
- Pre-duty alcohol use pursuant to 49 CFR § 382.207
- Alcohol use following an accident pursuant to 49 CFR § 382.209
- Drug Use pursuant to 49 CFR § 382.213
- The SAP’s report of the successful completion of the return-to-duty process
- A negative return-to-duty test
- The employer’s report of completion of employee follow-up testing
More FMCSA Information
Employers must prohibit drivers who have violated FMCSA’s drug and alcohol program regulations from performing safety-sensitive duties unless the driver has complied with the return-to-duty process.
In addition to registration with the Clearinghouse, FMCSA regulations require that employers add language to their FMCSA Drug and Alcohol testing policy to educate drivers and driver applicants that violations will be reported to the Clearinghouse.
